Pesticide Complaint Investigation & Enforcement Information

SDDA Compliance and Enforcement programs ensure compliance with state and federal laws and regulations through the following activities:

Apiary:

1. Inspection - Conducts permit, recordkeeping, sampling, and pest & disease inspections to ensure complaince with federal and state laws;
2. Enforcement - Conducts investigations of alleged apiary law violations on its own initiative or in response to a complaint from the public and assesses fines and penalties against violators; and
3. Pemitting/Certification/Registration - Issues permits, certificates, and registrations to move, place, and import bees and colonies to ensure freedom from pests and compliance with state and federal law.

Feed and Animal Remedy:

1. Inspection - Conduct labeling, sampling, analysis, storage, distribution, registration, manufacturing, production, preparation, packaging, and recordkeeping inspections to ensure complaince with federal and state laws;
2. Enforcement - Conducts investigations of alleged feed and animal remedy law violations on its own initiative or in response to a complaint from the public and assesses penalties against violators; and
3. Licensing/Registration - Licenses commercial feed manufacturers and guarantors to insure complaince with state and federal law. Registers animal remedy products to insure compliance with state and federal law.

Fertilizer and Soil Amendment:

1. Inspection - Conduct fertilizer and soil amendment guaranteed analysis sampling, proof of claims, labeling, storage, production, distribution, and recordkeeping inspections to ensure complaince with federal and state laws;
2. Enforcement - Conducts investigations of alleged agricultural fertilizer and soil amendment law violations on its own initiative or in response to a complaint from the public and assesses fines and penalties against violators; and
3. Licensing / Registration - Licenses fertilizer producers, dealers, and distributors and issues storage permits to ensure compliance with state and federal laws. Registers soil amendment products to insure compliance with state and federal law.

Nursery:

1. Inspection - Conducts nursery stock, decorative plants, annual plants, sod, or related plant products sampling, recordkeeping, health, labeling, production, and distribution inspections to ensure complaince with federal and state laws;
2. Enforcement - Conducts investigations of alleged nursery stock law violations on its own initiative or in response to a complaint from the public and assesses penalties against violators; and
3. Certificates - Issues certificates of inspection to sell, offer for sale, ship, distribute, or transport nursery stock to ensure freedom from pests and compliance with state and federal law.

Pesticide and Pesticide Registration:

1. Inspection - Conducts sampling, labeling, use, worker safety, and recordkeeping inspections to ensure compliance with federal and state laws;
2. Enforcement - Conducts investigations of alleged agricultural pesticide law violations on its own initiative or in response to a complaint from the public and assesses fines and penalties against violators; and
3. Licensing/Certification/Registration - Licenses, certifies, tests, and trains agricultural pesticide applicators to ensure competency. Registers pesticide products to ensure complaince with state and federal law.

2. Enforcement - Conducts investigations of alleged seed law violations on its own initiative or in response to a complaint from the public and assesses penalties against violators; and
3. Permiting - Issues permits to sell, distribute, advertise, solicit orders for, offers for sale, expose for sale, or transporting seed to ensure compliance with state and federal law.
